HIRE TERMS & CONDITIONS

These Terms & Conditions apply to all campervan and outdoor equipment hires provided by Halley Outdoors Ltd trading as Scotlander (“Scotlander”, “we”, “us”, “our”).

By making a booking, completing payment, collecting hired items, or otherwise hiring from Halley Outdoors Ltd trading as Scotlander, you confirm that you have read, understood and agreed to these Hire Terms & Conditions.


1. About Us

We provide campervan and outdoor equipment hire services throughout Scotland.


2. Who Can Hire

By booking with us, you confirm that:

  • you are legally able to enter into a binding agreement
  • all information provided is accurate
  • you accept responsibility for the hired vehicle or equipment for the full hire period
  • any children using hired equipment are supervised by a responsible adult

For campervan hire, drivers must also meet the eligibility requirements in Section 11.

We reserve the right to refuse hire where we reasonably believe safety, insurance or legal requirements are not met.


3. Booking & Payment

Bookings may be made online, by email, by telephone or in person.

Payment may be processed through third-party booking or payment providers.

Your booking is only confirmed once payment has been received.

We reserve the right to cancel bookings where payment cannot be successfully processed.


4. Security Deposit (Campervan Hire)

A refundable security deposit may be required before the start of the campervan hire period.

The deposit amount will be confirmed during booking or before vehicle collection.

The security deposit may be used to cover:

  • vehicle damage
  • insurance excess charges
  • theft or loss
  • cleaning costs beyond reasonable use
  • late return charges
  • fuel shortages
  • traffic fines or penalties
  • breaches of these Terms & Conditions

Insurance Claims

Where accidental vehicle damage occurs and an insurance claim is required, the security deposit may be retained in full or in part to cover the applicable insurance excess.

Any remaining repair costs covered by the insurer beyond the excess amount will normally be handled through the vehicle insurance policy.

Minor Damage

Where damage does not require a formal insurance claim, we may deduct the reasonable repair or replacement cost from the security deposit and refund the remaining balance.

Examples may include:

  • broken mirrors
  • damaged interior items
  • scratches
  • minor cosmetic damage
  • missing accessories

Return of Deposit

Where no additional charges apply, the security deposit will normally be released or refunded within a reasonable period following inspection of the vehicle.

We reserve the right to retain the deposit temporarily where:

  • damage is still being assessed
  • repair quotations are pending
  • traffic or parking penalties may still be received
  • insurance investigations are ongoing

5. Cancellations & Refunds

Equipment Hire

  • Full refund for cancellations made 48 hours or more before the hire start time
  • No refund for cancellations made within 48 hours of the hire start time
  • No refunds for unused hire time or early returns

Campervan Hire

  • More than 30 days before hire start: full refund minus any non-recoverable booking costs
  • 14–30 days before hire start: 90% refund
  • 7–14 days before hire start: 50% refund
  • Less than 7 days before hire start: 25% refund
  • Cancellation on or after the hire start date: no refund

We reserve the right to treat major booking changes as cancellations and rebookings where necessary.

Refunds are normally returned to the original payment method.


6. Collection & Return

Equipment or vehicles must be collected and returned at the agreed time and location.

You are responsible for checking the condition of all items before leaving.

Once collected, all items are considered accepted in satisfactory condition unless concerns are raised immediately.

Late returns may result in additional charges.

For campervans, failure to return the vehicle on time may result in additional daily hire charges and associated recovery or operational costs.


7. Damage, Loss & Theft

You are responsible for the hired vehicle or equipment during the full hire period.

You agree to:

  • take reasonable care of all items
  • keep vehicles and equipment secure
  • report damage immediately
  • return all items in reasonable condition
  • pay for loss, theft or damage beyond normal wear and tear

Charges may include:

  • repair costs
  • replacement costs
  • cleaning costs
  • recovery costs
  • loss of use where applicable

We may invoice you for these costs following inspection.


8. Safety & Proper Use

You agree to use all hired items safely, lawfully and only for their intended purpose.

Camping Equipment

  • Fuel-burning stoves must only be used outdoors
  • Equipment must not be used in unsafe weather conditions
  • Tents and shelters must be secured properly

Paddleboards & Water Equipment

  • Users are responsible for their own safety
  • Buoyancy aids and leashes are strongly recommended
  • Equipment should only be used within the user’s ability level and suitable weather conditions

Bikes

  • Helmets are strongly recommended
  • Riders must follow local cycling laws and road regulations

General

We are not responsible for accidents, injuries or damage caused by:

  • misuse
  • unsafe behaviour
  • failure to follow instructions
  • weather or environmental conditions
  • third-party actions

9. Equipment Demonstrations

Basic setup or usage demonstrations may be available on collection if requested.

If you choose not to request a demonstration, you accept responsibility for understanding how to safely use the equipment.

Instruction manuals or guidance provided should always be followed.


10. Insurance & Personal Responsibility

Customers are responsible for ensuring they have suitable personal travel, activity or cancellation insurance where appropriate.

Campervan hire includes standard vehicle insurance subject to insurer approval and driver eligibility.

Insurance does not remove responsibility for:

  • negligent damage
  • prohibited use
  • unauthorised drivers
  • breaches of these Terms

11. Campervan Driver Requirements

For campervan hire, drivers must:

  • hold a full valid driving licence
  • normally have held their licence for at least 2 years
  • meet insurer age and licence requirements
  • provide identification and proof of address if requested

We may require licence checks or additional documentation before releasing a vehicle.

Only approved drivers named by us may drive the vehicle.


12. Campervan Use Restrictions

Campervans must not be used:

  • for illegal purposes
  • while under the influence of alcohol or drugs
  • for racing, competitions or off-road driving
  • for carrying passengers for payment
  • for sub-hire or commercial use
  • by unauthorised drivers

You are responsible for:

  • parking fines
  • speeding fines
  • tolls
  • congestion charges
  • penalties incurred during the hire period

Vehicles must be returned with approximately the same fuel level as provided at collection unless otherwise agreed.

Incorrect fuel use may result in full recovery and repair charges.


13. Accidents & Breakdowns

In the event of an accident or breakdown:

  • stop safely as soon as possible
  • contact emergency services where necessary
  • contact us as soon as reasonably possible
  • do not admit liability to third parties
  • do not authorise repairs without our approval

Where breakdown cover is included, our nominated provider must be used.


14. Our Liability

Nothing in these Terms excludes liability where it cannot legally be excluded.

To the fullest extent permitted by law, we are not liable for:

  • indirect or consequential losses
  • loss of enjoyment
  • travel disruption
  • weather conditions
  • campsite cancellations
  • personal property damage or loss
  • third-party actions outside our control

Our total liability shall not exceed the total amount paid for the hire booking.


15. Force Majeure

We are not responsible for delays, cancellations or failures caused by events outside our reasonable control, including:

  • severe weather
  • flooding
  • accidents
  • strikes
  • natural disasters
  • road closures
  • vehicle breakdowns
  • government restrictions
  • internet or payment system failures

Where possible, we will attempt to offer alternatives or refunds at our discretion.


16. Privacy & Data Protection

We collect only the personal information reasonably required to manage bookings and hires.

Information may include:

  • names
  • contact details
  • booking information
  • driver information
  • payment status information

Payments may be processed by third-party providers.

We do not store payment card details directly.

17. Website & Third-Party Services

Our website may contain links or embedded services provided by third parties including booking systems, maps or payment providers.

We are not responsible for third-party websites or services.


18. Changes To These Terms

We may update these Terms from time to time.

Updated versions will be published on our website and will apply from the published effective date.


19. Governing Law

These Terms shall be governed by Scots law.

Any disputes shall be subject to the jurisdiction of the Scottish courts.
